These Terms of Service ("Terms") govern your access to and use of the websites, games, waitlist, contact forms, AI features, tastings, coupons, rewards, partner offers, content, and related services provided by Pourplay Inc ("PourPlay," "we," "us," or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

The Services are intended for legal drinking-age adults. You must be at least 21 years old, or the legal drinking age in your location if higher, to use any alcohol-related portion of the Services. By using the Services, you represent that you meet these age requirements.

What PourPlay Provides

PourPlay offers wine education, game-based learning, pairing content, AI-assisted wine guidance, waitlist and contact experiences, tasting-related content, rewards, coupons, partner campaigns, and related discovery tools.

PourPlay does not currently sell alcohol directly. Any wine purchases, shipments, tastings, coupons, rewards, or partner transactions are subject to the terms, policies, age verification, shipping restrictions, and legal obligations of the applicable licensed retailer, winery, partner, or service provider.

Educational Content And AI Features

PourPlay content, games, and AI outputs are provided for educational, entertainment, and discovery purposes only. AI-generated suggestions may be incomplete, inaccurate, or not suitable for your circumstances. You should use your own judgment and consult qualified professionals where appropriate.

PourPlay AI is intended for wine-related use. We may monitor, limit, remove, or block prompts, outputs, or accounts that violate these Terms, create safety issues, abuse the Services, or fall outside the intended scope of the Services.

Coupons, Rewards, And Offers

Coupons, rewards, partner drops, tasting offers, and promotional campaigns may be limited by date, quantity, geography, availability, eligibility, local law, and partner rules. Offers may change or end at any time. PourPlay is not responsible for partner inventory, pricing, fulfillment, shipping, taxes, age verification, or purchase decisions handled by third parties.

Unless expressly stated otherwise, coupons and rewards have no cash value, are not transferable, and may not be combined with other offers.

Accounts, Waitlists, And Communications

Some Services may require you to provide information, join a waitlist, create an account, or opt in to communications. You agree to provide accurate information and to keep it updated. You are responsible for activity associated with your account or submissions.

By providing your email address, you agree that we may contact you about the Services, including early access, tastings, games, coupons, partner drops, service updates, and responses to inquiries. You may unsubscribe from marketing emails where required by law.

User Conduct

You agree not to use the Services if you are under the required legal drinking age; submit false, misleading, unlawful, harmful, or abusive content; attempt to buy, ship, or receive alcohol where doing so is unlawful; interfere with or disrupt the Services; circumvent security, age-gate, rate-limit, or access controls; violate law or third-party rights; or misrepresent your identity or affiliation.

User Content And Feedback

If you submit messages, feedback, tasting notes, game inputs, preferences, images, or other content, you grant PourPlay a non-exclusive, worldwide, royalty-free license to use, host, reproduce, modify, analyze, and display that content as needed to operate, improve, protect, and promote the Services.

You represent that you have the rights needed to submit your content and that your content does not violate law or third-party rights.

Intellectual Property

The Services, including PourPlay names, logos, designs, text, graphics, software, games, interfaces, content, and other materials, are owned by PourPlay or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the Services except as allowed by these Terms or with our written permission.

Third-Party Services

The Services may link to or integrate with third-party websites, retailers, wineries, payment processors, analytics providers, social platforms, email tools, AI providers, or other services. We are not responsible for third-party services, content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Services, you also agree to the practices described in our Privacy Policy.

Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, PourPlay disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

We do not guarantee that the Services, coupons, rewards, partner offers, AI outputs, recommendations, or content will be accurate, uninterrupted, secure, available, or error-free.

Limitation Of Liability

To the fullest extent permitted by law, PourPlay and its officers, directors, employees, contractors, agents, affiliates, and partners will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, lost goodwill, or service interruption arising out of or related to your use of the Services.

To the fullest extent permitted by law, PourPlay's total liability for any claim arising out of or related to the Services will not exceed the greater of the amount you paid to PourPlay for the Services in the six months before the claim or $100.

Indemnification

You agree to defend, indemnify, and hold harmless PourPlay and its officers, directors, employees, contractors, agents, affiliates, and partners from any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your content, your violation of these Terms, or your violation of law or third-party rights.

Changes To The Services Or Terms

We may change, suspend, or discontinue all or part of the Services at any time. We may update these Terms from time to time. The "Last updated" date shows when the Terms were last revised. Your continued use of the Services after an update means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, unless applicable law requires otherwise.
